"Learner with high ability means a student who gives evidence of high performance capability in such areas as intellectual, creative, or artistic capacity or in specific academic fields and who requires accelerated or differentiated curriculum programs in order to develop those capabilities fully.”
(Nebraska Rev. Stat. § 79-1107)
Each school must develop a system to identify learners with high ability as defined in the theoretical definition. The system shall:
004.01A. Use mulitple assessment measures and appraisals so that schools can identify students in different talent areas and at different ages.
004.01B. Provide students with equal access to identification opportunities.
004.01C. Identify talents that are not readily apparent in students, as well as those that are obvious.

The identification process shall include multiple criteria in an effort to be inclusive rather than exclusive. This process shall be based on the elements listed above, a combination of standardized instruments and non-standardized means and criteria, and a local needs assessment.

"Those exceptionally able students who possess or demonstrate high levels of ability, in one or more content areas, when compared to their chronological peers in the local district and who require modification of their educational program if they are to achieve in accordance with their capabilities."
District boards of education shall be responsible for identifying gifted and talented students and shall provide them with appropriate instructional adaptations and services.
i. District boards of education shall make provisions for an ongoing K-12 identification process for gifted and talented students that includes multiple measures.
